Terms and Conditions

ORGANISATION

The Turkish Airlines EuroLeague Bracket Challenge (the “Bracket Challenge”) is organized by Euroleague Ventures SA (the “Organizer”).

Participation constitutes the Participant full and unconditional agreement to these Terms and Conditions and to Organizer's decisions. The decisions of the Organizer with regards to all matters of this Bracket Challenge are final and binding.

Organizer reserves the right in its sole discretion to modify, amend, cancel, terminate and/or suspend the Bracket Challenge and to disqualify any individual who tampers with the entry process, violates these Terms and Conditions, acts in a disruptive or unsportsmanlike manner, violates these Terms and Conditions, the Game Rules or the rights of any person or in any way brings the Bracket Challenge, Euroleague Ventures SA, Euroleague Basketball or any of its participating teams and/or their brand names into disrepute. Without limiting the foregoing, the Organizer may lock out a Participant who, in Organizer's sole judgement, has been disqualified, has questionable eligibility or is otherwise ineligible to enter.

A person who attempts deliberately to undermine the legitimate operation of this Bracket Challenge or to alter or damage the website may be subject to civil and/or criminal penalties and fines; and Organizer reserves the right to seek damages from any such person to the fullest extent permitted by law.

Without limiting the foregoing, the Organizer may modify, cancel, terminate, and/or suspend the Bracket Challenge if, in the Organizer's sole opinion, an incident of any kind occurs to corrupt or impair the administration, security, integrity, fairness or play (as intended) of the Bracket Challenge, including without limitation: (a) viruses, bugs, unauthorized human intervention, fraud or technical failure; or (b) earthquake, flood, fire, storm or other natural disaster, act of God; or (c) labor controversy or threat thereof, civil disturbance or commotion, disruption of the public markets, war or armed conflict (whether or not officially declared), terrorism or credible threat thereof. In the event that the Bracket Challenge is postponed, terminated early, or cancelled for any reason (such as a strike or lockout), Organizer reserves the right to award prizes based on scores at the time the season is disrupted, or to cancel, modify or suspend the Bracket Challenge at its discretion. In the event of a cancellation or termination by the Organizer the Participant who has accumulated the highest point total (and who wins any pending tiebreakers) at the time of any said action will be awarded the prizes, or the prizes will be awarded in such other manner deemed fair and appropriate by Organizer.

The Organizer reserves the right to amend these Terms and Conditions at any time. Any changes to the Bracket Challenge will be notified on the Platform as soon as possible by the Organizer.

Any and all rights in relation to the Bracket Challenge are the sole and exclusive property of the Organizer. No information or data may be reproduced in any format or used in any way without the prior written consent of the Organizer, who shall be entitled to withhold consent at its sole discretion.

 

RELEASE AND INDEMNITY

The Participants agree that no liability shall attach to the Organizer as a result of the exercise of any such discretion above referred and hence shall not result in any compensation being payable or paid to any Participant (including winner) or other person.

By participating In the Bracket Challenge or receiving a prize, Participants (including winner) agree to release and to indemnify and hold harmless the Organizer and each of Its respective related companies, and all of its respective officers, directors, employees and agents for any liability, Injury, death, loss or damages to Participant or any person or entity, Including without limitation damage to personal or real property, caused In whole or In part, directly or Indirectly by participation In this Bracket Contest (or related activities) or the acceptance, possession or use or misuse of a prize.

 


DISCLAIMERS

The Organizer is not responsible for:

- Applications, bracket submissions or results lost or delayed in the course of transmission.

- Electronic registration applications or bracket submissions that are either "undeliverable" or that remain undelivered which nullify the application and result in the participation in the Bracket Challenge not being accepted.

- Applications, bracket submissions or messages which are either not received or wrongfully sent or are "undeliverable" or remain for any reason undelivered.

- Incorrect or inaccurate information, whether caused by Participant, printing errors or by any of the equipment, hardware, software or programming associated or sed with the Bracket Challenge.

- Unauthorized human intervention (e.g. hacking).

- For any damage, loss, injury or disappointment suffered by any Participant entering the Bracket Challenge.

- For any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination thereof, including any injury or damage to Participant's or any other person's computer or mobile telephone related to or resulting from participation in the Bracket Challenge.


DISPUTE / CHOICE IN LAW

Except where prohibited, each Participant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Bracket Challenge or any prize awarded shall be resolved Individually, without resort to any form of class action, and exclusively by state or federal courts situated In Luxembourg; (2) any and all claims, judgements and awards shall be limited to actual out-of-pocket costs Incurred, but In no event attorney's fees and (3) no punitive, Incidental, special, consequential or other damages, Including without limitation lost profits may be awarded (collectively "Special Damages"), and (4) Participant hereby waives all rights to claim Special Damages and all rights to have such damages multiplied or Increased.

 

HOW TO PARTICIPATE

To take part in the Bracket Challenge you need to register using either your EuroLeague ID account or your social media account (Facebook, Instagram, Twitter or Google). Participation is free. Employees of the Organizer are not eligible for participation.

Fans who wish to participate in the Bracket Challenge shall enter the website http://bracket.euroleague.net (the “Platform”), register by introducing their EuroLeague ID or social media account details and make their bracket predictions. Applications must adhere to the required format.

The Organizer may refuse, withdraw, edit or delete any application and team names that in the judgement of the Organizer violates these Terms and Conditions or the Game Rules or which may be offensive, inappropriate, illegal or violates the rights of any person or in any way brings the Bracket Challenge, the Organizer, the Euroleague Basketball or its participants teams and/or their brand names into disrepute. Unsuitable names will be deleted and the team will appear under a default name supplied by the Organizer. Please bear this in mind when choosing the name for the team.

Each user will be able to create up to five (5) brackets related to one account.

Predictions can be made only within specific period as established In the Game Rules section. Selections submitted after the corresponding deadline are considered invalid.

All picks for the matchups must be submitted, received and recorded by the Organizer computer by the scheduled lock time. Selections submitted after the deadline are considered invalid.

The computer record of the registration application with the predictions will be considered as being the formal application. Any application not adhering to these Terms and Conditions or the Game Rules, incorrect applications or incomplete applications will be deemed invalid.


The Organizer reserves the right to exclude entrants when they do not meet the requirements set forth in these Terms and Conditions and/or in the Game Rules for the full duration of the Bracket Challenge.

PRIZES

Please take a look at the Prizes section.

As It can be seen In Its corresponding section, prizes are the following ones:

“Grand Prize”: four (4) Turkish Airlines EuroLeague tickets for the 2022-23 regular season, for any game(s) selected by the winner

“Silver Prize”: one (1) EuroLeague TV season pass for the 2022-23 season

“Bronze Prize”: one (1) EuroLeague Spalding Basketball

The prizes are not transferable. No cash alternative to material prizes is offered. Prizes are subject to availability and the Organizer reserves the right to substitute any prize with another of similar value without giving notice.

Winner acknowledges that should any taxes or legal requirements be applicable to the prize according to the country of the entrant, these shall be the responsibility of the winner.

All potential winning entries are subject to verification by the Organizer, whose decisions are final. The Organizer shall solely determinate any form of verification. A Participant is not a winner of any prize unless he/she has confirmed his/her email according to what is established in "How to participate" section and until Participant's eligibility and the potential winning entry has been verified and Participant has been notified that verification is complete. The Organizer will not accept screenshot, affidavits or other evidence of winning in lieu of its validation process.

Potential winner will be notified via email sent within thirty (30) business days following the end of the Turkish Airlines EuroLeague Final Four (Final Four is expected to finish by May 21) to the same email address provided at the time of participation. It is the sole responsibility of the Participant to notify the Organizer if his or her e-mail address has changed after the submission of his/her bracket. A potential winner will be disqualified and an alternate potential winner will be selected (following the order of the points ranking) if (i) he/she does not comply with these Terms and Conditions or the Game Rules (or is otherwise determined to be ineligible), (ii) he/she does not respond to the prize notice within five (5) calendar days of its transmission (prize notice shall be deemed to have been received when the email is sent provided that no failure message is received) or (iii) the prize is undeliverable for any reason.

If the Organizer notifies, or seeks to deliver a prize to or otherwise attempts to contact an alternate potential winner, and such alternate potential winner is subsequently disqualified then the Organizer shall use its reasonable business judgment to determine, in its sole discretion, the disposition of the prize (e.g., may choose another alternate potential winner in a manner consistent with these Terms and Conditions and the Game Rules donate the prize to another entity or cancel the prize, at its sole discretion). Winning a prize is contingent upon fulfilling all requirements set forth herein. Winner is solely responsible for any and all expenses, relative to participation in Bracket Challenge (including acceptance of any prize) not specified herein.

 

PARTICIPANT'S DECLARATION

Participant agrees to be bound by these Terms and Conditions entering the Bracket Challenge by submitting the registration and the bracket predictions.

By submitting a registration application, the Participant hereby warrants that all information submitted is true, current and complete.

Participation In this Bracket Challenge constitutes Participants and expressly winner's consent to Organizer and any of Its representative agents, partners and collaborators to use their name, likeness, voice, opinions and biographical Information for publicity, advertising, trade or promotional purposes In any media or manner, now known or hereafter devised, worldwide without payment, consideration notice or approval.

Participants are solely responsible for the EuroLeague ID account they use and the information they provide (the “Submissions”). Participant understands and agrees that registration application constitutes permission for the Organizer and Euroleague Basketball Media Partners (Fanatik, Gazzetta.gr; Gazzetta.it; As.com; Sports.ru and Lequipe.fr) to use the names, team selections and, if pertinent, photographs of Participants and/or Winners at its discretion, for publicity purposes. In particular, the Organizer has the intention to publish winner's name and, if available, a photo of the winners, on the EuroLeague official Website and on the Euroleague Basketball Media Partners website and printed publications. By participating in the Bracket Challenge, the Participants explicitly agree to a publication of their name and, if available, photo, if winning the Bracket Challenge and if this is wished by the Organizer.

Participants represent and warrant that: (i) they are free to participate into and are fully authorised to participate into the Bracket Challenge; (ii) the Submissions they have entered are true; (iii) the Submissions shall not violate any privacy rights, copyrights, contract rights or other rights of any person.

Participants understand the software of the Bracket Challenge is the property of the Organizer. No information or data in relation to the software of the Bracket Challenge may be reproduced in any format or used in any way without the prior written consent of the Organizer, who shall be entitled to withhold consent at their sole discretion.


These Terms and Conditions have been drafted in English. The Participants acknowledge and agrees that they have read and understood these Terms and Conditions and that are fully aware of the rights and obligations arising therefrom.

Participants acknowledge that taxes or legal requirements may be applicable to the prize according to the country of the Participant.


PRIVACY POLICY

Participation in the Bracket Challenge will be done using an EuroLeague ID or a social media account (Facebook, Twitter, Instagram or Google). The data that we will collect from the participants is the following: name and surname, email, date of birth, country, gender and telephone number.

In case of winners, we may request you for your passport details and/or bank details for the sole purposes of providing you with the prize. This data will be immediately erased once we have delivered the prize.

All personal information submitted will be included in a database property of Euroleague Ventures, S.A (postal address: 60 Grand-rue, L-1660 Luxembourg) and managed by Euroleague Entertainment & Services S.L.U., with registered address at C/ Quatre Camins, 9-13, 08022 Barcelona, Spain and WME|IMG, LLC with registered address at 731 Lexington Avenue, New York, NY 10022, for the purposes of managing your participation In the Bracket Challenge and to manage, If applicable, the reward of the prizes and, upon your express approval, to send you commercial Information about Euroleague Basketball and our partners and collaborators.

Under the GDPR you may exercise your right of access, rectification or deletion of data, request the processing to be restricted, oppose it or request data portability at any time by sending a written notice to Euroleague Ventures SA, 60 Grand-Rue L-1660 Luxembourg, or by sending an email to [email protected]

Participants understand that the Privacy Policy applies to their participation in the Bracket Challenge.
